1. Introduction and Acceptance of Terms

Welcome to Synda ("the App," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Synda mobile application, website, and related services (collectively, the "Services").

By downloading, installing, accessing, or using Synda, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

These Terms constitute a legally binding agreement between you and Synda. We reserve the right to modify these Terms at any time. Your continued use of the Services after any modifications indicates your acceptance of the updated Terms.

2. Description of Services

Synda is a mobile application designed for open water swimmers that provides:

  • Swim Spot Discovery: Access to a database of wild swimming and open water swimming locations worldwide
  • GPS Tracking: Location-based tracking of swimming activities
  • Environmental Data: Information about water conditions, weather, tides (where available)
  • Social Features: Activity feeds, community interactions, events, and clubs
  • Achievement System: Badges, leaderboards, and progress tracking
  • Subscription Services: Premium features available through paid subscriptions

3. Eligibility

To use Synda, you must:

  • Be at least 13 years of age (or the minimum age required in your jurisdiction)
  • If under 18, have parental or guardian consent to use the Services
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Services under applicable laws

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access

You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account at any time.

5. Disclaimer of Liability - IMPORTANT

5.1 No Liability for Swimming Activities

SYNDA IS NOT LIABLE FOR ANY INJURIES, DEATHS, ACCIDENTS, OR DAMAGES OF ANY KIND THAT MAY OCCUR DURING OR AS A RESULT OF YOUR SWIMMING ACTIVITIES.

Open water swimming is an inherently dangerous activity. By using Synda, you acknowledge and accept that:

  • Swimming in open water carries significant risks including drowning, hypothermia, cardiac events, encounters with marine life, strong currents, and other environmental dangers.
  • You assume all risks associated with open water swimming and any activities you undertake based on information provided through the App.
  • Synda does not guarantee the safety of any swimming location, regardless of any ratings, reviews, or condition data displayed in the App.
  • Environmental data is provided for informational purposes only and may be inaccurate, outdated, or incomplete.

5.2 No Guarantee of Data Accuracy

Synda provides environmental and condition data from various third-party sources. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY DATA, including water temperature, weather, tides, and other conditions.

YOU MUST ALWAYS INDEPENDENTLY VERIFY CONDITIONS before entering any body of water.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SYNDA SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or goodwill
  • Any personal injury or death
  • Any property damage
  • Any damages arising from your use of or inability to use the Services

Cap on Liability: In no event shall our total liability exceed the greater of the amount you paid to Synda in the twelve (12) months preceding the claim, or one hundred US dollars ($100).

7. Indemnification

You agree to indemnify, defend, and hold harmless Synda and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses arising from or related to your use of the Services, your violation of these Terms, your swimming or other activities, and any content you submit.

8. User Conduct and Content

You agree not to:

  • Use the Services for any illegal purpose
  • Post false, misleading, or defamatory content
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Interfere with or disrupt the Services

By submitting content to Synda, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content.

9. Subscription and Payment Terms

Synda offers free and premium subscription plans:

  • Monthly: $8.95 USD per month
  • Annual: $64 USD per year (save 40%)

Subscriptions are billed in advance on a recurring basis. You may cancel at any time through your app store subscription settings. Refund policies are governed by the respective app store (Apple App Store or Google Play Store).

10. Intellectual Property

Synda and its licensors own all rights, title, and interest in the Services, including all intellectual property rights. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

You may not copy, modify, distribute, reverse engineer, or decompile the Services, or remove any proprietary notices.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

12. Third-Party Services

The Services may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is at your own risk.

13. Modifications to Services

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Services.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration.

15. Safety Warnings and Recommendations

OPEN WATER SWIMMING IS DANGEROUS.

Before swimming, you should:

  • Check conditions independently - Do not rely solely on Synda
  • Swim with others - Never swim alone in open water
  • Inform someone - Tell someone where you're going and when you expect to return
  • Know your limits - Do not exceed your swimming ability
  • Wear appropriate gear - Consider wetsuits, swim caps, and safety buoys
  • Be visible - Wear bright colors and use safety devices
  • Check for hazards - Look for currents, tides, marine life, and obstacles

Cold Water Warning: Cold water swimming poses additional risks including cold water shock, hypothermia, and cardiac arrest. Acclimatize gradually and know the signs of cold water distress.

16. Acknowledgment

BY USING SYNDA, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms and Conditions
  2. You agree to be bound by these Terms
  3. You understand that open water swimming is dangerous
  4. You assume all risks associated with swimming activities
  5. Synda is not liable for any injuries, deaths, or damages
  6. Environmental data may be inaccurate and should be independently verified
  7. You are solely responsible for your safety
